Terms and conditions
The rules for using Moti: what each plan includes, how subscriptions work and what rights you have as a user.

1. Who we are
The Moti app and the site motiapp.online are owned by Carlos Villadiego, based at Mz 32 Lote 22, Barrio Rancho Grande, Montería, Córdoba (Colombia). You can reach us at devcarlos93@gmail.com.
2. Accepting these terms
By downloading, installing or using Moti you accept these terms and conditions. If you do not agree with them, please do not use the app.
These terms sit alongside our privacy policy, which explains how we handle your data, and the terms of the store you downloaded the app from (App Store or Google Play).
3. What Moti is
Moti is a phone and tablet app that helps you focus: it turns goals into missions with small steps, times your focus sessions and breaks, and tracks your progress through a virtual companion that evolves as you use it.
4. Using the app and minimum age
We grant you a personal, limited, revocable, non-exclusive and non-transferable licence to use Moti on the devices your app store allows, strictly for personal, non-commercial purposes.
You must be of legal age to use Moti. If you are under 18, you need authorisation from whoever holds parental responsibility or custody over you.
You are responsible for the device you use and for keeping secure the App Store or Google Play account linked to your purchases.
5. Free plan
Moti's free plan includes, at no cost and with no time limit:
- an unlimited focus and break timer;
- creating missions and steps by hand, without restrictions;
- one AI-generated mission per day;
- the companion Moti and its evolution.
We may adjust the scope of the free plan in future. If we do so in a way that removes features you were already using, we will tell you in advance inside the app.
7. Right of withdrawal (retracto)
Article 47 of Law 1480 of 2011 (the Colombian Consumer Statute) grants a right of withdrawal for sales made by non-traditional or distance methods, which is the case for in-app purchases. The period is five business days from delivery of the goods or conclusion of the contract.
Because this is digital content made available to you immediately, withdrawal may not apply once you have started using the feature you bought. In practice, withdrawal and refunds are handled through App Store or Google Play, which apply their own procedures and are often more flexible than the legal minimum.
If the purchase was made with a card or any other electronic payment instrument, you may also request a payment reversal in the cases and within the deadlines of article 51 of Law 1480 of 2011.
8. Restoring purchases
If you change device or reinstall the app, you can recover your purchase from Settings → Restore purchases. You must use the same App Store or Google Play account you bought it with: purchases are tied to that account and cannot be transferred to another one.
9. AI-generated content
AI-generated missions are automated suggestions. They may contain errors, inaccuracies or proposals that do not fit your particular situation. Review and edit them before following them: how you organise your work is always your decision.
We do not guarantee any specific outcome from using these suggestions, nor that the feature will be available without interruption, since it depends on external providers.
The text of the goals you submit is handled as described in the corresponding section of the privacy policy.
10. Acceptable use
When using Moti, you agree not to:
- use the app for unlawful purposes or in ways contrary to these terms, good faith or public order;
- enter unlawful or offensive content, or content that infringes third-party rights, into your goals and missions;
- attempt to access our systems without authorisation, interfere with their operation or deliberately overload them;
- decompile, reverse engineer or attempt to extract the app's source code, except to the extent the law expressly allows;
- circumvent free-plan limits or the purchase verification mechanisms;
- resell, sublicense, rent out or commercially exploit the app or its content.
11. Intellectual property
All intellectual and industrial property rights in Moti — including the software, the interface design, the companions and their illustrations, the text, the sounds, the brand and the logo — belong to Carlos Villadiego or its licensors.
These terms grant you a licence to use, not a transfer of rights. No right of reproduction, distribution, public communication or adaptation is granted beyond the personal use described here.
The content you create is yours. The goals and missions you write belong to you. We only process them to provide the service, as described in the privacy policy.
12. Availability and changes to the service
We work to keep Moti continuously available, but we do not guarantee uninterrupted or error-free availability. The service may be affected by maintenance, updates, third-party provider failures or events beyond our control.
We may modify, add or withdraw features to improve the product or for technical, legal or security reasons. If a change substantially and negatively affects a feature included in an active subscription, we will tell you a reasonable time in advance and you will be able to cancel.
We may discontinue the service with at least 30 days' notice inside the app, allowing you to export or keep your information and respecting the rights arising from subscriptions already paid for.
13. Liability
We are liable for loss or damage we cause you through your use of Moti where it results from a breach on our part, on the terms set out in applicable law.
We accept no liability for:
- how you use AI-generated suggestions, or the results you obtain by following them;
- data loss caused by deleting the app, your device failing, or your not keeping backups;
- interruptions attributable to your carrier, your device or third-party services;
- your own breach of these terms.
14. Suspension and termination
You can stop using Moti at any time by uninstalling the app and, where applicable, cancelling your subscription through your store.
We may suspend or terminate your access if you seriously or repeatedly breach these terms, giving notice wherever reasonably possible. If termination happens for reasons not attributable to you and you had an active subscription, we will refund the unused portion on a pro-rata basis.
15. Governing law and complaints
These terms are governed by the laws of the Republic of Colombia. Colombian courts have jurisdiction over any dispute, without prejudice to the mandatory consumer protection rules that may apply based on your place of residence.
Before turning to any other forum, please write to us at devcarlos93@gmail.com: most problems are resolved that way.
As a consumer you may file a complaint with the Superintendency of Industry and Commerce, the authority responsible for both consumer protection and personal data protection in Colombia.
